"This report relates to troubles growing out of the claims to lands under Georgia titles, these being asserted against the United States soon after the surveys consequent on the Cherokee and Chickasaw cessions" [Owen]. It provides a wealth of data on the founding settlement of this Northern Alabama county, which was formed on December 31, 1808, by the Governor of the Mississippi Territory; its County seat today is Huntsville. The Report includes a census of the Heads of Families in the County, with information on adult white males, white males under age 21, free white females under age 21, free white adult females, and the total number of slaves per family. Most families owned either no slaves or one slave. The champion slaveholder was Benjamin Williams, who owned 27. White inhabitants totaled about 22, and slaves 322. The Report also has detailed information on the "squatters" on federal public lands, the steps taken to assist the settlers in obtaining good title, and the extent of compliance. Tables of 282 applications for tracts of public lands, with their locations, are printed. Michael Harrison, a serious troublemaker, claimed a vast expanse of territory under a purported Georgia title and was reselling tracts to unsuspecting settlers. Complaints by "industrious honest citizens" against Harrison's vigilante tactics are printed; Thomas Freeman, the government surveyor, advises Secretary Gallatin that, if Harrison interferes with his work, "I shall burn him out." The Committee attempts to cure the uncertain status of land titles that resulted from the Spanish evacuation of the Mississippi Territory. "Many persons holding lands" under Spanish authority, "who were either ignorant of the transfer of the country to the United States, or of any legal defect in their titles, neglected to obtain patents for their lands," although under Spanish law they had evidently perfected their titles. The Committee recommends respecting those titles, especially as "the claims are generally for small tracts of land, and in many instances the lands have been inhabited and cultivated for a number of years." An unsophisticated copy of this plea by landowners in the Yazoo area of Mississippi Territory for federal assistance in quieting titles to land that they purchased from Spain. Others had been granted the same land by England during the prior British ownership of the Territory. The Report explains the history of the Spanish and British claims to the area, and lists the British grants of land filed with the register of the land office. FIRST EDITION. AI 33474 [5].

The Committee responds to a request from "the inhabitants of the Mississippi Territory" for "an appropriation of lands in the territory, by Congress, for the support of 'clergymen and seminaries of learning, and such like purposes.'" The Committee evidently sees no constitutional problems with the request, since similar "appropriations have been made in the North Western Territory"; but it opposes the grant because of "the unsettled condition of claims to lands in the Mississippi Territory." Burling et al, owners of land in the Mississippi Territory, claimed title to their property derived from Spanish land grants. They seek an Act of Congress confirming their title; but the Committee presents an unfavorable report, since Burling's request would interfere with the recent Act of Congress to fix Georgia's boundary, establish a government for the Mississippi Territory, and settle title to conflicting land claims. A "Yazoo Fraud document" [De Renne]. The Committee responds to the dilemmas created by "the uncertainties and interfering claims, to which the rights and locations of land in the Mississippi Territory are liable." The Report is a detailed and thorough review of the history of competing colonial-era Spanish and English claims to the Territory from the latter 17th century; the grants and laws passed by the State of Georgia, fixing boundaries and procedures for acquisition of property; the Georgia-South Carolina boundary dispute; Georgia's land cessions to the United States, and its tainted grants to the Mississippi Companies. The Committee justly concludes, with several Resolutions, that the vast muddle of land titles thus resulting "deserve[s] the immediate attention of Congress." I De Renne 294. Evans 38897. Mississippi Territory:
THE MISSISSIPPI TERRITORY OF THE UNITED STATES.
Broadside injunction, oblong 11.5" x 7.25". Printed with names, dates and details in manuscript. The signature 'Theodore Stark' appears in the left margin, although his connection with the case is unclear; however, a contemporary Theodore Stark was a notary in the Mississippi Territory. Tanned, light wear, Very Good. This is a rare legal writ issuing from the Superior Court in the early Mississippi Territory. The writ prohibits Morgan from proceeding with a suit to recover possession of a house and lot from Terrell and Isler. Judge Walter Leake, from whose court the writ issued, would serve as Mississippi's U.S. Senator from 1817-20 and as governor from 1822-1825. The first settler of Mt. Salus, he owned at least two dozen slaves, according to 1816 and 1820 census reports. Brigadier General Morgan, whom the court enjoined from prosecuting the suit, would command the 'Brigade of Louisiana and Mississippi Drafted Militia' during the Battle of New Orleans. His co-defendant, Edward Turner, a lawyer, was Aide-de-Camp and private secretary to Governor Claiborne of the Mississippi Territory. He also served as Clerk of the House of Representatives and as a Clerk of the County Court in Jefferson County. Peter Isler, who was in possession of the house and lot, was a printer to the Mississippi Territory and later to the State. He established the Mississippi Republican newspaper in 1810. Richard Terrell of Adams County is listed in the Mississippi and Territory Census of 1816 as owning twelve slaves.
