He then considers "the grave question of how far the people in rebellion have forfeited their right of person and property;" warns that proscription of an entire "people by wholesale" is surely unconstitutional; and reviews the constitutional limitations on the national government's power to punish treason, and impose disabilities and penalties on the erstwhile rebels.
