On the organization of the Council, and whether Governor Pennington "had the lawful right and authority to come into the Council, preside over us, and give a casting vote." The Whigs said he did; but Scott here expresses his "unutterable disgust...From the nature and spirit of our institutions, and from the direct command in the constitution, the Council, like the House of Assembly, was, and ought to be, a self-organizing and independent body, and that no officer or person other than themselves should take any part in that act."
