COMMUNICATION FROM HIS HONOR THE MAYOR, TRANSMITTING THE OPINION OF JUSTICE ROOSEVELT, GIVEN ON THE 9TH JULY, 1859, ON SETTING ASIDE THE JUDGMENT AND ALL SUBSEQUENT PROCEEDINGS IN THE WEST WASHINGTON MARKET CASE. DOCUMENT NO.

1859. 6. New York: 1859. Original printed wrappers, stitched, 29pp. Foxed, Good+. A dispute over a lease granted by the State of New York's Land Office Commission to James B. Taylor "of the entire land, known as West Washington Market, with the piers adjoining the same." Taylor immediately sought the eviction of 186 tenants "who occupied stands for market purposes on the land." The City of New York intervened, claiming that it had rightful ownership and possession of the land, and sought the termination of all proceedings against the tenants. The State's entitlement to ownership was, as Judge Roosevelt says here, "not very satisfactorily explained in the papers before the Court." Accordingly, he calls the State's purported lease to Taylor void. FIRST EDITION. Not in Sabin or NUC. Item #15247
