Binney's eulogy is a detailed biography of Marshall, including his lineage and his services in the Revolutionary War. "He was one of that body of men, never surpassed in the history of the world, who, unpaid, unclothed, unfed, tracked the snows of Valley Forge with the blood of their footsteps in the rigorous winter of 1778." Binney examines Marshall's early years at the Bar, his involvement in the political issues of Virginia before adoption of the Constitution, his legislative and diplomatic career, and his inestimable contribution as Chief Justice to American constitutional law and the Union. Binney singles out for especial praise the decision in the Dartmouth College Case. Haynes alone records a second Philadelphia printing, which he surmises also issued in Haynes 1552.
