I[saac] B. Williams [1813-1871] brought the Petition as attorney for the Estate of Joshua Upchurch, on behalf of his widow and various heirs. Joshua died in Henry County in November 1844. Williams had practiced law in Tennessee since 1836. An advertisement in the West Tennessean on 29 March 1839 notes that his firm, located in Paris in Henry County, practiced in the local and federal courts, and Chancery Courts in Henry and adjoining counties. Williams was elected Attorney General for the Ninth Judicial District of Tennessee in 1844, Chancellor of the 3rd Western Chancery Division, and appointed Judge of the 13th Judicial Circuit upon the death of Judge William Fitzgerald, his father-in-law.
Judge William Fitzgerald [1799-1864], to whom this Petition was assigned, was Clerk of the Circuit Court of Stewart County, Tennessee, from 1822-1825; a member of the Tennessee House of Representatives from 1825-1827; Solicitor General of 16th District Tennessee from 1826-1831; member of the U.S. House of Representatives from 1831-1833; and Judge of the Ninth Judicial Circuit Court of Tennessee from 1845-1861.
The Upchurch family had settled in Henry County by the early 1800s. Joshua Upchurch [1800-1844] was listed in the 1840 U.S. Federal Census as the owner of fourteen slaves. Other Upchurches noted in the Petition were farmers and small business-people. Item #38797
